Representation Matters : Tenants

While representation does matter in the work place, colleges, sports and other social arenas, this article is why it is imperative for real estate consumers to have representation in their rental or lease transactions.


Why seek representation?

The mere fact that you are borrowing someone else’s property should immediately tell you how serious you should take the matter.


When leasing from reputable property management companies you can have confidence in the leasing agent taking care of you. However, keep in mind they represent the owner, so their loyalty lies with them.


On the flip side you have private owners or landlords. These individuals are not monitored by the SC LLR or an association with a code of ethics , so they are more prone to poor practice in renting to tenants. With that, it is important that you have representation to ensure they are following the LAW and have ethical practice.


SC Residential Landlord and Tenant Act protects both parties, but it’s important for tenants to understand their rights.


Here’s three scenarios to look out for:

  1. Landlord never gives you a ratified copy of your lease agreement.

  2. Landlord takes more than 48 hours to respond, during the application process.

  3. Landlord is pushing you to take the property “as-is”.

The last scenario to look out for when dealing with private landlords is discrimination. Of course it can happen with property management companies, but it is more prone to occur with landlords. Fair Housing Laws protects more than just racial discrimination but the following: color, national origin, religion, sex, familial status, and disability.


Even in the application process you need to be aware of how you can be discriminated against and what to do if you feel you have been discriminated against.
